Legal flaws in half of disability cases

The Danish Council of Appeal on Health and Safety at Work’s ‘Handicapsagsbarometret 2023’ found legal issues in 51% of 385 cases regarding escort services for adults with disabilities. Common problems included insufficient information about support needs. Legal errors impacted the Board’s evaluation in 47% of those cases. The significant challenge faced by municipalities was determining the correct Service Law provision for the services. Louise Holck, Director of the Danish Institute for Human Rights, raised concerns that even unappealed cases exhibit errors, preventing individuals from receiving needed aid. The Institute’s report from December highlighted over 25,000 mistakes in Board-reviewed disability cases between 2014-2022, with some 6,605 decisions being directly incorrect and 18,484 cases returned to municipalities due to procedural errors.
