Government to allow public access to bankruptcy offender list
The Danish government proposes a law granting access to information in the bankruptcy register, almost four years after its initial proposition in 2020. This move aims to prevent individuals and businesses from dealing with irresponsible operators who have previously been given a bankruptcy quarantine after sinking a company by gross negligence. Justice Minister Peter Hummelgaard believes this will help prevent significant financial losses to consumers, businesses, and the public. Directors under quarantine cannot lead a limited liability or stock company, typically for three years. Since the introduction of bankruptcy quarantine in 2014, 11,711 quarantines have been imposed. The new model, based on proposals from the Bankruptcy Council in summer 2023, allows the public to search active quarantines. However, the IT register access is not yet determined, leaving the public waiting for its implementation.
