New deal to secure rights for surrogacy children
Denmark is set to update its laws to ensure children of foreign surrogates have quicker legal ties to their parents. As reported by Berlingske and articulated by minister for Social Affairs and Housing, Pernille Rosenkrantz-Theil (S), this change addresses the disparity where such children have unequal starts in life. Currently, only the biological father of a child born to a surrogate mother is recognized, but the new proposal will enable immediate parental recognition upon the child’s arrival in Denmark. This adjustment will potentially affect about 100 children arriving yearly. Stepchild adoption processes, which take months, will no longer be the only avenue for the non-biological parent to gain legal rights. Prospective parents using surrogacy must provide biological linkage to the child and a statement from the surrogate relinquishing parenthood.
