Prison to pay for illicit recording
Storstrøm Prison in Denmark breached an inmate’s rights by recording his phone calls with a legal trainee, the Supreme Court ruled, awarding the inmate 10,000 kroner. Lawyer Claus Bonnéz believes this exposes a long-standing improper practice within prisons. The Court’s decision expands confidentiality rights to include legal trainees, and potentially other legal advisors, beyond just attorneys. Previously, the Correctional Service had been acquitted by lower courts but now must adjust its policies in light of the Supreme Court’s ruling. The guidelines on calls with legal advisors were altered before autumn 2023, and after this ruling, the Correctional Service may further specify these guidelines.
