Supreme Court decides on transgender inmate’s transfer
For nine years, a 63-year-old transgender woman, legally recognized as female, has been incarcerated among male inmates. She claims this violates the European Convention on Human Rights and has sued the Danish Prison Service and Herstedvester Prison to be transferred from the male division. Lower courts ruled against her, stating that although legally female, she is biologically male, has not undergone gender reassignment surgery, and poses a security risk. Previous convictions for particularly dangerous rapes were noted. The Supreme Court is examining the case, with a decision pending at a later date.
